Agreement to these terms
These Terms of Use (“Terms”) govern your use of the Intel Advance website (the “Site”). By using the Site or submitting an application, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Who may use the Site
The Site is intended for people who are at least 18 years old and who are seeking commercial financing on behalf of a business located in the United States. By submitting an application, you confirm that you are authorized to act for the business named in it.
Business purpose only
Intel Advance provides commercial financing for business purposes only. Our products are not available for personal, family or household purposes.
No offer or commitment
Information on the Site, including descriptions of products, funding amounts, speed of funding and eligibility guidelines, is general information only. It is not an offer, approval or commitment to provide financing. All financing is subject to underwriting review and approval, and the actual amount, cost, terms and timing depend on your business’s circumstances.
Any financing is governed solely by the written agreement you sign with Intel Advance and the disclosures provided with it. If anything on the Site conflicts with your signed agreement, the agreement controls.
A merchant cash advance is the purchase of a portion of a business’s future receivables and is not a loan. Short-term business loans and debt consolidation financing are loans and are governed by the terms of their own agreements.
Same-day funding
Same-day funding is available on business days for qualified applicants who complete their application, provide all requested documents and sign their agreement before 4 PM ET. Funding times may be affected by bank processing times, holidays, verification requirements and other factors outside our control, and are not guaranteed.
Your information and authorizations
You agree that the information you provide to us is true, complete and current, and that you will update it if it changes. Providing false or misleading information may result in your application being declined or your agreement being terminated, and may be reported to the appropriate authorities.
Before final approval, we may ask you to authorize us to obtain credit reports and to verify the information you provided. Any such authorization will be requested from you separately.
Communications
By submitting an application or contacting us, you agree that Intel Advance may contact you by phone call, text message and email at the contact details you provide about your application and our products, as described in our Privacy Policy. Message and data rates may apply. You may opt out of marketing messages at any time; consent to marketing is not a condition of obtaining financing.
Acceptable use
You agree not to:
- Use the Site for any unlawful or fraudulent purpose, or to submit an application on behalf of a business you are not authorized to represent.
- Impersonate any person or business, or misrepresent your affiliation with anyone.
- Interfere with or disrupt the Site, or attempt to gain unauthorized access to it or to our systems.
- Use automated tools to scrape, copy or submit information through the Site.
- Upload or transmit viruses or other harmful code.
Intellectual property
The Site and its content, including text, design, graphics and the Intel Advance name and logo, are owned by or licensed to Intel Advance and are protected by intellectual property laws. You may view and print pages for your own use in evaluating our services. You may not copy, modify, distribute or use them for any other purpose without our written permission.
Third-party links and services
The Site may link to or rely on websites and services operated by others. We do not control them and are not responsible for their content, policies or practices.
Disclaimers
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Intel Advance disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Site will be uninterrupted, secure or error-free.
Nothing on the Site is legal, tax, accounting or financial advice. You should consult your own advisors before entering into any financing.
Limitation of liability
To the fullest extent permitted by law, Intel Advance and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, arising out of or related to your use of the Site. This section does not limit any rights or obligations under a financing agreement you sign with us.
Indemnification
You agree to indemnify and hold harmless Intel Advance and its owners, employees and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your submission of false or misleading information.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in New York, and you consent to their jurisdiction. Disputes relating to a financing agreement are governed by the terms of that agreement.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and Intel Advance about your use of the Site.
